Terms of Service

01Agreement

These Terms of Service are an agreement between you and Toweliee ("we", "us"), the developer of RUSTWAKE ("the game"). By installing or playing the game, you agree to these terms and to the Privacy Policy. If you do not agree, do not install or play the game.

If the store you got the game from has its own end-user terms, those also apply. Where they conflict with these terms, the store's terms win for that part.

02Your license to play

We give you a personal, non-exclusive, non-transferable, revocable license to install and play the game on computers you own or control, for your own non-commercial entertainment. The license lasts as long as you follow these terms.

You are licensed to use the game. You do not buy the game itself, its code or its assets.

03What you may not do

• Sell, rent, lend, sublicense or redistribute the game or any part of it.
• Extract the game's models, textures, sounds or other assets to use in another game, product or service.
• Remove or change copyright notices, credits or license files that come with the game.
• Use the game, or anything taken from it, to train machine-learning or AI models.
• Use the game to break any law.

Nothing in these terms takes away rights you have under the law where you live, such as a legal right to reverse engineer software for compatibility.

04Mods, videos and screenshots

Videos, streams and screenshots

You may stream the game, record and publish gameplay videos, and share screenshots, including on monetized channels. A link back to the game is appreciated. We may ask you to remove content that is offensive or that misrepresents the game.

Mods

You may change your own copy of the game, for example by editing data files or writing mods, and share mods for free. Shared mods must not include the game's original files or assets, and must not be sold. You use mods at your own risk, and we do not support them. Back up your saves before using a mod.

05Online co-op

Co-op sessions are hosted by players on their own computers and connect players directly. We do not run, moderate or monitor them, and we are not responsible for what other players do in a session.

• Do not cheat, use exploits or modified files to disrupt other players' sessions, crash their games or damage their saves.
• Do not harass, threaten or abuse other players, or try to use their IP address to attack, locate or track them.
• When you host, you decide who joins. Hosting over the internet may require changing your router settings, and you do that at your own risk.
• Your progress is kept in your own save. Co-op is new and may desync or disconnect, so back up your saves.

We may change or remove co-op features in any update. Problems with other players can be reported in the official RUSTWAKE Discord server.

06Early Access

RUSTWAKE is in Early Access. The game is unfinished and may contain bugs, crashes and performance problems. Features, balance and content can change, be added or be removed in any update. An update may make older save files incompatible, so back up the Saved/SaveGames folder before updating.

We are not obligated to release updates, to finish any feature or to support the game for any length of time.

07Content and health warning

The game contains realistic firearms, combat violence, mature themes and a post-apocalyptic setting. It is intended for players aged 13 and over.

08Third-party content and services

Assets

The game includes material made by others under their own licenses:

• Unreal Engine, by Epic Games
• Models, textures and HDRIs from Poly Haven (CC0)
• Materials from ambientCG (CC0)
• Characters and animations from Microsoft Rocketbox (MIT License)
• The Bebas Neue typeface (SIL Open Font License 1.1)

Those licenses apply to those parts of the game. The full list is on the game's Credits screen.

Discord

If you use Discord, the game can show your activity as your Discord status. Your use of Discord is governed by Discord's Terms of Service. We are not responsible for Discord or any other third-party service.

09Ownership

The game, including its code, story, world, characters, logo and artwork, belongs to us or our licensors and is protected by copyright and other laws. "RUSTWAKE" and its logo are our trademarks. These terms do not give you any right to use them except to play the game and to share content as section 4 allows.

10No warranty

To the extent the law allows, the game is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the game will be free of errors, will run on your hardware, or will keep your save files safe.

11Limit of liability

To the extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for lost data, lost profits or damage to your computer, arising from your use of the game. Our total liability to you for any claim is limited to the amount you paid for the game, or US$10 if you paid nothing.

Some places do not allow these limits, so some of them may not apply to you.

12Ending these terms

You can end these terms at any time by uninstalling the game and deleting your copies. Your license ends automatically if you break these terms. Sections 8 to 12 continue to apply after the terms end.

13Governing law

These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-law rules. If you live in a country whose consumer laws give you rights that cannot be waived, those rights still apply. If any part of these terms cannot be enforced, the rest stays in effect.

14Changes

We may update these terms as the game develops. When we do, we will change the effective date at the top of this page and announce material changes where the game is distributed. If you keep playing after a change takes effect, you accept the updated terms.
